**Business Owner Ronnie Call, owner of Soul Dawgs, has been cited several times by The Town of Waynesville for using a small "flag" sign for advertising his Hot Dog Stand across from the Ingles in West Waynesville/Hazelwood Area. Apparently the sign is legal, except for being a bit too tall. However, The Town of Waynesville is "on it", and has the time to cite Ronnie on this "Ordinance Issue" while ignoring other Town Ordinances located in The Town of Waynesville's Code of Ordinances in Sec. 42.2-42.4; which would apply to most of the vagrants, addicts, homeless, etc. now roaming, camping, drinking, shootin up, running around half naked, dropping needles, having sex in public, and loitering all over the Town of Waynesville.

**Business Owner Dustin Smith, owner of Triangle Automotive, has simply wanted to operate his business and has made many reasonable requests for variants in the Town of Waynesville in order to continue to operate a growing business successfully. However, the Town has been rigid in their response to Dustin and will not budge an inch to accomodate a very successful business owner who provides many valuable jobs in Waynesville.

**The Town of Waynesville "cherry picks" ordinances to enforce or ignore. The Town is "ok" with a Vagrant having possession of Needles, Crack Smoking Kits, Meth, Cocaine, Fentynal, and running around half naked, peeing, pooping, camping, sleeping, etc. on Town property, but a small business is held to every letter of the "law". The Bethel House was zoned "Office Use Only" as The Town of Waynesville looked the other way and allowed it to operate as a low barrier Shelter, with NC Harm Reduction Coalition as a Tenant.

Again, please read and study The Town of Waynesville's Code of Ordinances in Sec. 42.2-42.4 which would currently apply, but is ignored by the Town, to most of the vagrants, addicts, homeless, etc. now roaming, camping, drinking, shooting up, running around half naked, having sex in public, dropping needles, and loitering all over Town.


**Sec. 42-2. - Acts prohibited in a public place.

The purpose of this section shall be to prohibit certain acts in public which by their very nature are recognized as having serious objectionable characteristics. Studies and experiences have shown that lower property values and increased crime rates tend to result if such acts are permitted. This section is adopted to prohibit certain acts detrimental to the health, safety or welfare and the peace and dignity of the town.(b)It shall be unlawful for any person, knowingly or intentionally, in a public place, to:(1)Engage in sexual intercourse;(2)Appear in a state of nudity;(3)Fondle or otherwise perform an erotic touching of the genitals or pubic region or female breasts of himself/herself or another person; or(4)Perform an act of human masturbation.(c)It shall be unlawful for the owner or operator of any place of entertainment, including a restaurant, club, dance hall, or any other public establishment of any kind, to allow or permit any waiter or waitress, dancer, entertainer, or other employee or visitor of such establishment to perform any of the acts listed in subsection (b) of this section in such establishment.(d)It shall be unlawful for an entertainer in any place of entertainment, including a restaurant, club, dance hall or other public establishment of any kind to cover the female breast below a point immediately above the top of the areola with an opaque covering in the same color or similar color to that of the entertainer's skin tone.(e)It shall be unlawful for the owner, operator, manager, employee, entertainer, customer or patron of any restaurant, club, dance hall or any other public establishment of any kind to knowingly touch, fondle or caress the genitals, pubic area, buttocks, or female breasts of another person or himself/herself, whether such areas are clothed, unclothed, covered or exposed, while on the premises of the restaurant, club, dance hall or other public establishment.(f)The term "nudity" means the showing of the human male or female genitals, pubic area, or buttocks with less than a fully opaque covering; the showing of female breast with less than a fully opaque covering of any part of the female breast below a point immediately above the top of the areola, or the showing of covered male genitals in a discernible turgid state, even if completely and opaquely covered.(g)Violations of this section shall be a class 3 misdemeanor punishable upon conviction in accordance with section 1-8. With respect to subsection (b) of this section, each separate incident shall constitute a separate offense. With respect to subsection (c) of this section, each day's violation shall constitute a separate offense.

· Sec. 42-3. - Consuming alcohol or possessing open containers of alcohol while on town recreation facilities.

It shall be unlawful for a person while on the property of the town at any of the town's recreation facilities or parks to possess fortified or unfortified wine, spirituous liquor or any malt beverage in other than the manufacturer's unopened original container.(b)It shall be unlawful for a person while on the property of town recreation facilities and parks to consume fortified or unfortified wine, spirituous liquor or any malt beverage.(c)The definitions of fortified or unfortified wine, spirituous liquor and malt beverage shall be the same as the definition in G.S. 18B-101.(d)Violations of this section shall be misdemeanors, punishable in accordance with section 1-8.

· Sec. 42-4. - Consumption or possession of alcohol on the public streets and sidewalks of the town.

It shall be unlawful for a person to consume a malt beverage or unfortified wine on the public streets or sidewalks owned, occupied or controlled by the town.(b)It shall be unlawful for a person to possess an open container of malt beverage or unfortified wine on the public streets or sidewalks owned, occupied or controlled by the town.(c)It shall be unlawful for any person to possess or consume malt beverages or unfortified wine on public streets, sidewalks, alleys or parking lots which are closed to regular traffic for special events.(d)For the purpose of this section, the term "open container" means a container with a seal that has been broken or a container other than the manufacturer's unopened original container. The terms "malt beverages" and "unfortified wine" are defined in G.S. 18B-101.(e)The board of aldermen may adopt a resolution making other provisions for the possession and consumption of malt beverages and/or unfortified wine at special events of the town or at special community festivals. Any resolutions that may be adopted shall provide for the specific times, dates and geographical limitations of the special event or festival.(f)Violations of subsections (a), (b) and (c) of this section shall be misdemeanors, punishable upon conviction in accordance with section 1-8.
