**With the Local Municipal Elections to be held this November, Please again find below information about the North Carolina Syringe Exchange Law (NC GS 90-113.27) enacted in 2016, the Haywood County Needle Exchange Resolution passed unanimously by our Haywood County Commissioners supporting local regulation of Needle Exchange Programs, and information on Article II, Sec. 24 (1) (a) of the NC State Constitution.

The Haywood County Needle Litter Resolution was a good start, however, the Commissioners should follow up with the citizens on whether they "will" or "will not" go beyond the Resolution and enact an actual Ordinance that can be enforced. Please Read, Study, and Share the information below:

Text of the Haywood County Needle Litter Resolution:

BOARD OF COMMISSIONERS COUNTY MANAGER BRYANT MOREHEAD L. KEVIN ENSLEY, CHAIRMAN BRANDON C. ROGERS, VICE CHAIRMAN COUNTY ATTORNEY J. W. “KIRK” KIRKPATRICK, III FRANK G. QUEEN TOMMY LONG JENNIFER M. BEST RESOLUTION SUPPORTING LOCAL REGULATION OF STERILE NEEDLE EXCHANGE PROGRAMS The Board of Commissioners of Haywood County resolve as follows: WHEREAS the issue of the spread of hypodermic needle litter in the public spaces of Haywood County is a continuing matter of public concern; and WHEREAS state law specifically authorizes the establishment and operation of programs to combat the transmission of communicable diseases using, as part of those programs, the exchange of used hypodermic needles for sterile needles, pursuant to N.C. Gen. Stat. § 90-113.27; and WHEREAS the citizens of Haywood County, acting through their local governments, have expressed their desire to reduce used-needle litter by potentially regulating the operation of needle-exchange programs; and WHEREAS such local regulations could potentially require the establishment of “sharps” containers, regulate the locations of the distribution of needles and deal with similar issues. NOW, therefore, be it resolved that the Board of Commissioners of Haywood County expresses its support for authorizing legislation from the General Assembly of North Carolina for the local regulation of programs that involve the distribution, collection and exchange of hypodermic needles. This Haywood County Needle Resolution is essentially asking the NC General Assembly for permission to regulate or ban local Needle Exchanges by asking them to "authorize legislation" for "local regulation" of needle exchanges.

However, The NC State Constitution (Article II Sec. 24 (1) (a), leaves that responsibility with them (local County and City Governments) to enact local legislation "relating to health, sanitation, and the abatement of nuisances" (aka needle litter), and actually "prohibits" the NC General Assembly from enacting such legislation. Article II, Sec. 24 (1)(a).. clearly states,

"Limitations on local, private, and special legislation".
(1) Prohibited subjects. The General Assembly shall not enact any local, private, or special act or resolution:
(a) Relating to health, sanitation, and the abatement of nuisances;


The North Carolina Needle/Syringe Exchange Law (§ 90-113.27) does not prohibit local Governments from regulating needle/syringe exchanges. See link below:

**Other States, Cities and Counties across the U.S. have enacted their own Needle Litter/ Exchange Ordinances.
Please find links to recently approved Ordinances (Butte County Ord. # 4201, Chico City Ord. # 2561, and Oroville City Ord. # 1842) Banning Needle Exchanges. Many other cities and counties within California, Washington State, Indiana, New Jersey, etc. have done the same. West Virginia also has a new Needle Exchange law (WV SB 334) that regulates needle exchanges requiring “one for one” exchange, a state ID for all recipients of needles, distributor logo/label on each needle given out, and harsh penalties (up to $10,000) for distributors that violate the regulations.
