County Commissioners have the Power to Enact an Ordinance Against Needle Litter and Needle Handouts in Haywood County

Citizens learned, during the election of 2022, NC Harm Reduction hands out needles and crack kits to drug addicts and drug dealers in Haywood County for their meth, crack and heroin fixes. An article written by Vera explains how NC Harm Reduction operates in our county. Needles are being handed out by the thousands and many discarded and infected needles end up everywhere from childrens ballfields to trashed up homeless camps near our children's schools. This Vera article explains how NC Harm Reduction engages with drug pushers who sell drugs in Haywood County.

Harm Reduction and Needle Exchange Policies are still strongly supported by most local Non-Profits, The Town of Waynesville Aldermen, and the Haywood County Commission Chairman. We are fortunate to have the (First In NC) Needle Resolution, however, we need much more regulation (County Ordinance or NC State Law) to reign in the extensive Needle Litter-Drug Addiction-Crime problem currently in Haywood County and NC. County Attorney Frank Queen states in this Smoky Mountain News article, the county is prohibited by Article II Section 24 of the North Carolina State Constitution from passing a local ordinance on the subjects of health, sanitation or the abatement of nuisances, and citizens have discovered the wording under Article II Section 24 allows the county to pass a needle ordinance to protect the citizens from discarded, infected and diseased needles.

Why has NC Representative Mark Pless failed to introduce a Needle Exchange Bill to the NC General Assembly as promised?

NC Representative Mark Pless plans to introduce a Needle Exchange Bill to the NC General Assembly. We, as Haywood County Citizens, should strongly support Rep. Pless in this endeavor. This new bill will be similar to West Virginia's New Needle Exchange Law, which includes a "1 for 1" component. There are questions about the legality of "1 for 1" restrictions, for NC Needle Exchanges. However, the current Needle Exchange Law in NC does not prohibit "1 for 1" restrictions. As Citizens, we should communicate with Rep. Pless frequently, to help him format a solid Needle Exchange Bill, that will have the best chance of success, and build upon the recent Needle Exchange Resolution passed, unanimously, by the Haywood County Commissioners. **The Haywood County Commissioner's unanimous vote on a Needle Litter Resolution last fall was a good start, however, the NC State Constitution leaves the responsibility of local legislation relating to health, sanitation, and the abatement of nuisances to the local legislative bodies in NC. Please sign the new petition below that simply asks our local County Commissioners to honor their responsibility, as per the NC State Constitution, and either ban or regulate all Needle Exchanges in Haywood County since Needle Litter has become a "Health Issue", a "Sanitation Issue", and a "Public Nuisance".
